Terms of Service

1. Overview

These Terms govern your use of the Site and any purchases or orders placed via the Site, including orders submitted through third-party forms (e.g., Tally Forms). The terms “we”, “us” and “our” refer to ONO design.

We may update these Terms at any time by posting revised Terms on the Site. It is your responsibility to review the Terms periodically. Continued use of the Site after posting of changes constitutes acceptance of those changes.

2. Eligibility & Account Responsibility

By agreeing to these Terms, you represent that you are of legal age to form a binding contract where you reside. You are responsible for all activity under any account you create and for maintaining the confidentiality of your account credentials. You must provide accurate, current, and complete information.

3. Hosting, Order Capture & Third-Party Tools

  • The Site is hosted on Wix. Wix provides the online platform used to operate the Site.

  • Order submissions are collected via Tally Forms. Tally acts as a data processor for order capture; please review Tally’s privacy terms.

  • We may provide or link to optional third-party tools, and we have no control over their terms, performance or security. Your use of any third-party tool is at your own risk.

4. Orders, Payment & Fulfilment

  • We do not process payments on the Site. Customers are responsible for arranging payment externally (e.g., bank transfer, third-party payment providers) as instructed during order confirmation.

  • When you submit an order via our Tally form, you authorize us to use the information you provide to process, confirm, and fulfil your order.

  • We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, suspected fraud, or violation of these Terms. If an order is cancelled after payment has been made externally, we will provide a refund through the payment method agreed at time of order (subject to your cooperation and any applicable refund policy).

5. Product Information, Pricing & Availability

  • We attempt to accurately display product images and descriptions; however, colors and representations may vary by monitor or device.

  • Prices and availability are subject to change without notice.

  • Offers are void where prohibited. We reserve the right to limit quantities and to refuse service.

 

6. Accuracy of Account & Billing Information

You agree to provide current, complete and accurate account and contact information. We may contact you using the email or Instagram account you provide. We are not responsible for delayed responses due to inaccurate contact information.

7. Returns, Refunds & Exchanges

Returns, refunds and exchanges are governed by our Refund Policy. Please review the Refund Policy linked on the Site for details on eligibility, timelines and procedures.

8. Use Restrictions & Prohibited Conduct

You must not use the Site to:

  • Violate any law or infringe third-party rights;

  • Upload or transmit harmful code (viruses, malware);

  • Misrepresent identity or submit false information;

  • Scrape, harvest or collect personal information of other users;

  • Interfere with or circumvent Site security.

We may terminate or suspend access and take legal action for violations.

 

9. User Content & Submissions

If you submit comments, designs, suggestions, or other content (excluding personal order info), you grant ONO design a perpetual, royalty-free, transferable, sublicensable right to use, reproduce, modify and publish such content for any purpose. You warrant that you own or control all rights to the content you submit and that it does not violate third-party rights.

 

We are not required to keep submissions confidential and have no obligation to compensate contributors.

 

10. Intellectual Property

All Site content (text, images, graphics, logos, product designs, code) is owned or licensed by ONO design and protected by copyright, trademark and other IP laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

 

11. Disclaimers; No Warranty

The Site, Services and products are provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, ONO design disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

 

12. Limitation of Liability

We do not guarantee that the Site or Services will be uninterrupted, timely, secure, or error-free. You use the Site and our products at your own risk. Everything is provided “as is” and “as available”, without any warranties, unless we clearly state otherwise.

 

ONO design 202503300804 (KT0601825-T) is not liable for any loss or damage of any kind – including lost profits, data loss, replacement costs, or any indirect or consequential damages – arising from your use of the Site, our Services, or our products.

 

We are not responsible for delays or failures caused by events outside our control (e.g., government restrictions, natural disasters, system outages, or similar disruptions).

We are also not liable for any damage caused to our products due to improper care, misuse, or negligence by the customer.


13. Indemnification

You agree to indemnify and hold harmless ONO Design and its officers, directors, employees and agents from any claims, losses, damages or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.

14. Force Majeure

We are not liable for failure to perform obligations caused by events beyond our reasonable control, including natural disasters, strikes, government restrictions, pandemics, or other force majeure events.

15. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

16. Termination

We may suspend or terminate your access to the Site for any reason, including breach of these Terms. Termination does not relieve you of obligations incurred prior to termination.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of Malaysia. Any disputes arising out of or related to these Terms will be subject to the exclusive jurisdiction of the Malaysian courts, unless otherwise required by applicable law.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on the Site with an updated effective date. Continued use constitutes acceptance of changes.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other policies posted on the Site, constitute the entire agreement between you and ONO Design regarding the Site and Services.
